Micuri, Inc. (“StyleScore,” “we,” or “us“) respects your privacy and is committed to being transparent about our privacy practices. This Privacy Policy describes the types of information we may collect from you when you visit our website at www.stylescore.com, or any subdomains thereof, or visit or use our mobile software application known as “StyleScore” or any related mobile or desktop applications, including any content or functionality offered on or through any of the foregoing (collectively, the “Site”), or when you access or use the online services we make available on the Site (collectively, the “Service”). This Privacy Policy also describes our practices for collecting, using, maintaining, protecting, and disclosing such information
This Privacy Policy applies to information we collect on the Site, in email, text, or other electronic messages between you and the Site, and through your access to or use of the Service through the Site. Except as otherwise expressly set forth herein, it does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party, nor to information collected by any other third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site or the Service.

Please read this Privacy Policy carefully before you start to use the Site or the Service to understand our policies and practices regarding how we treat your information. By accessing or using the Site or the Service in any manner, you accept and agree to be bound by this Privacy Policy. If you do not agree with any terms of this Privacy Policy, you may not access or use the Site or the Service for any purpose.

This Privacy Policy may change from time to time (see Updates to Our Privacy Policy, below). Your continued use of the Site or the Service after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. PRIVACY OF CHILDREN

The Site and the Service are not intended for use by minors as defined in their jurisdiction of residence. We do not knowingly collect personal information from children. For users in the United States, in accordance with the Children’s Online Privacy Protection Act (COPPA), we do not collect personal information from anyone under 13 years of age without verifiable parental consent. If you are under 13, please do not attempt to register for our Services or send any personal information about yourself to us. For users outside the United States, if you are under the age of majority in your country of residence (which may be 16, 18, or another age depending on your location), you may only use our Site and our Service with the involvement and consent of a parent or legal guardian. If we learn that we have collected personal information from a child under the applicable age limit without appropriate consent, we will take steps to delete that information as quickly as possible. 2. INFORMATION WE COLLECT

Information you Provide Us.   When you sign up for or use StyleScore you voluntarily share certain information including your name, email address, phone number, gender, date of birth,  photos, videos, text in the form of comments or chat, and any other information you give us. You can also choose to share your precise location using your device settings or through photos. You will also have the option to share other information about yourself such as your gender, age, date of birth and preferences.
If you’ve explicitly granted device-level permissions, you may also provide us with device information, including, without limitation, your device address book (contacts and related information), images and other information from your device’s camera, photos, and microphone (like the ability to take photos, videos, view stored photos and videos, and access the microphone to record audio while recording video), and location information (precise location through methods like GPS signals).
Information we Collect by Automatic Means. Additionally, when you navigate through and interact with the Site and/or the Service, we may use automatic data collection technologies to collect certain information about your equipment, browsing, actions, and patterns, including:

  • Information about the devices you use to access the Site (such as the IP address and the type of the device, operating system, and web browser)
  • Dates, times, and duration of use of the Site (including whether you are a repeat or first time visitor);
  • Information on actions taken when using the Service (such as page views and website navigation patterns);
  • In-Service messages sent or received by you (“User Messages”)
  • Information about your online activities over time and across third-party websites or other online services (behavioral tracking).

Information we collect automatically may be statistical data that does not include personal information. We may maintain or associate any such statistical data with personal information we collect in other ways or receive from third parties. It helps us to estimate our audience size and usage patterns, speed up user experience, and to improve and personalize the Service, including enabling us to identify and authenticate users. To the extent that we associate any of this non-personal information with your personal information, we will treat it as personal information under the terms of this Privacy Policy.

Technologies we use for automatic data collection may include cookies. A cookie is a small file placed on the hard drive of your computer. Pages of our Site and our emails may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Third Party Use of Cookies and other Tracking Technologies. Some content or applications on the Site are served by third-parties, including content and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about any targeted content, you should contact the responsible provider directly.
Biometric Authentication. Certain mobile devices may permit you to log on to the Service using your unique facial features instead of using your username and password. Your device will store the information it needs to recognize you, however our Service is only utilizing your device’s functionality to recognize your image and permit you to log in. You can enable or disable biometric authentication at any time through your user account.

3. USE OF YOUR INFORMATION

We may use information we obtain about you, or that you provide to us:

  • To make available the Service and to provide you with products and services you request

  • To facilitate the exchange of User Messages between you and other users of the Service

  • To send you information or materials you request

  • To provide or make available to you targeted advertisements, content, and suggestions

  • To respond to your questions and comments and provide customer support

  • To communicate with you about our products, services, offers, and promotions

  • To operate, evaluate, and improve our business and the products and services we offer

  • To identify trends and insights with respect to your purchasing behaviors and fashion preferences, which we may use to display targeted advertisements to you and to otherwise help tailor our fashion recommendations and advertisements to your needs and preferences

  • To analyze trends and statistics regarding use of the Service and transactions conducted using the Service

  • To protect against and prevent fraud, unauthorized transactions, claims, and other liabilities, and manage risk exposure, including by identifying potential hackers and other unauthorized users

  • To enforce our Terms of Service and other agreements

  • To comply with applicable legal requirements and industry standards

  • For any other purpose for which you provide your consent.

4. SHARING OF YOUR INFORMATION

We may disclose aggregated information about our users, and information that does not identify any individual user, without restriction.
We may disclose personal information that we collect or you provide (as described in this Privacy Policy) as follows:

  • StyleScore Community. To provide our Services to you and our community, we may share information with your friends on StyleScore or other users on StyleScore. For example, we may suggest other users on our platform that are part of your address book to add as friends or friends. We may also share your information to facilitate the exchange of User Messages between you and other users of the Service.
  • Third-Party Apps. Sometimes we provide features that allow you to connect with third-party apps. If you decide to connect your StyleScore account with a third-party app, we will share any additional information you direct us to.
  • Third-Party Service Providers. We share information about your activity with our service providers, who process that information on our behalf. For example, we rely on such Service Providers to provide shopping recommendations, merchandise, services or measure and optimize the performance of ads. We do not share private communications with them. For more information, see “Third-Party Service Providers” below.
  • Business and Integrated Partners. We share information about your activity with business and integrated partners in order to provide the Services. For example, you can use links or other shopping apps within StyleScore to view or purchase other merchandise or services. These partners may use your information to identify and analyze trends and insights with respect to purchasing behaviors and fashion preferences, both with regard to you and the generalized user base, to display targeted advertisements to you, and to otherwise help tailor fashion recommendations, advertisements, and purchasing options to your personal needs and preferences.
  • Anti-Fraud Partners. We share information about your activity, such as device and usage information, with industry partners working to prevent fraud.
  • Legal, Safety, and Security Partners. We share information about your activity as necessary for the following legal, safety, and security reasons: (i) complying with any valid legal processing, governmental request or applicable law, rule or regulation; (ii) investigating, remedying or enforcing our Terms of Service; (iii) protecting the rights, property or safety of us, our users or others; and (iv) detecting and resolve any fraud or security concerns.
  • For the purposes of a Merger or Acquisition. If we were to sell or negotiate to sell our business to a buyer or possible buyer, we may transfer your personal information to a successor or affiliate as part of that transaction.
  • Other purposes. We may also share your information for any other purpose which is incidental to the normal use of the Service for any other purpose for which you provide your consent.
  • Advertising. We may also disclose personal information to third parties to market their products or services to you if you have not opted out of these disclosures.

Please note that certain of the disclosures to third parties set forth above may, subject to your opt-out rights, occur by means of a sale of your personal information to such third parties (i.e., in exchange for monetary or other consideration). 5. THIRD-PARTY SERVICE PROVIDERS

Without limiting the foregoing, we may also employ or otherwise utilize third party companies and individuals to facilitate our Site and our provision of the Service, and to process data, perform Site-related services, or to assist us in analyzing how the Service is used (collectively, “Third Party Providers”). These Third Party Providers may have access to your personal information for purposes of performing these tasks on our behalf, and may have the right to retain and use personal information or other information through performance of these tasks on an aggregated and de-identified basis in accordance with the terms of the applicable Third Party Provider’s privacy policy. We advise you to review the privacy policies of the Third Party Providers, but note that we have no control over and assume no responsibility for the content, privacy policies or practices of any Third Party Providers, their websites or services.
Categories of Third Party Providers may include, but are not limited to: web analytics providers, online retailers, content creation and management services, and advertising creation and management services. 

6. SECURITY

StyleScore takes protecting your information seriously, and has implemented reasonable measures to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the Service or certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

We urge you to be careful about giving out information in public areas of the Site or through interactions with other Service users. The information you share in public areas may be viewed by any user of the Service. Please use caution in determining what personal information to disclose.

Please note that the electronic transmission of information is not completely secure. We cannot guarantee that the security measures we have in place to safeguard information will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of information is at your own risk.

7. INTERNATIONAL DATA TRANSFERS

The Service is administered by StyleScore in the United States. When we obtain information about you through your access to or use of the Site or the Service or when you input or import information to the Service from somewhere other than the United States, we may transfer, process, and store such information in the United States. If you access the Site and/or Service from outside the United States, you do so on your own initiative, at your sole risk, and you are responsible for compliance with all applicable laws. If you are a non-United States resident and provide us with your personal information, or if you use the Service, you consent to the transfer to and processing of such information in the United States, which may have data protection laws less stringent than those in the country in which you reside. 

8. SECURITY

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Cookies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Site and the Service may then be inaccessible or not function properly.
  • Notifications. The Service may deliver notifications to your mobile device from time to time. You can disable these notifications by changing notification settings on your mobile device.
  • Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending an email to us with your request at [email protected].
  • Opt-out of Sales of Your Information. You have the right to direct us to not sell your personal information at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us at [email protected].
  • Emails. StyleScore may send Service updates, Service notifications, promotional information and other communications to you via email. Promotional email communications will contain instructions describing how you can opt out of receiving future promotional emails from us. If you opt out of promotional emails, you may continue to receive non-promotional, transactional emails from us.
  • Account Deletion. You may elect to delete your user account at any time, which will automatically deleted all information and content you have submitted to or through such user account.
  • Limiting Provided Information. You can choose not to provide us with certain information. If you decline to provide certain information, however, please note that some features of the Site and/or Service may then be inaccessible.

9. DO NOT TRACK REQUESTS

Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. The Site is not currently set up to respond to those signals.

10. THIRD PARTY APPLICATIONS AND WEBSITES

The Site and/or Service may contain links enabling the electronic transfer of data from third-party applications to the Site or the Service, as well as links to third-party websites. StyleScore is not responsible for the privacy practices or content of these applications or websites, and linking to an application or website does not constitute endorsement by us of that application or website. You should review the privacy policy and terms and conditions of any such third-party application or website prior to using or providing information to the same.

11. ACCESSING AND CORRECTING YOUR INFORMATION

You may send us an email at [email protected] to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If you delete your User Content, copies of your User Content or correspondence may remain viewable in cached and archived pages, or might have been copied or stored by other users.

12. HOW LONG WE KEEP YOUR INFORMATION

As a general rule, we keep information as long as you tell us to, and otherwise as long as we need it to provide our Services, or as required by law. Whether we retain your data depends on the specific feature, your settings, and how you’re using the Services. Here are some more factors we consider when we decide how long to keep your information:

  • If we need the information to operate or provide our Services. For example, we store your basic account details — like your name, phone number, and email address — to maintain your account. We may store other account details like age, gender and your photos to customize your experience.
  • To do the things you expect from our Services and as we’ve described within this Privacy Policy. For example, we maintain your list of friends until you ask us to delete them since friends are key to providing opinions and helping you be the best version of yourself.
  • The information itself. For example, we store location information for different lengths of time based on how precise it is and which Services you use. Photos and videos within your closet are stored until you delete them. Notifications and chats are deleted within approximately 7 days. We may provide options for you to change the deletion period in the future.
  • How long we need to retain the information to comply with certain legal obligations.
  • If we need it for other legitimate purposes, such as to prevent harm, investigate possible violations of our Terms of Service or other policies, investigate reports of abuse, or protect ourselves or others.

Although our systems are designed to delete some of your information automatically, we cannot promise that deletion will take place by a specific time.
In some cases we need to comply with legal requirements to store your data which stops us from deleting your information. For example, if we receive a notice from a court asking us to keep a copy of your content. Other reasons we may be required to keep a copy of your data are if we get reports of abuse or other Terms or policy violations, or if your account, content created by you, or content created with other StyleScore users is flagged by others or our systems for abuse or other Terms or policy violations. Finally, we may also keep certain information in backup for a limited period of time or as required by law.

13. YOUR STATE PRIVACY RIGHTS

California Residents. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by email at [email protected] or write to us at the mailing address set forth at the end of this Policy.

Colorado, Connecticut, Texas, Virginia, and Utah Residents. Colorado, Connecticut, Texas, Virginia, and Utah each provide their state residents with rights to: (i) confirm whether we process their personal information; (ii) access and delete certain personal information; (iii) data portability; and (iv) opt-out of personal data processing for targeted advertising and sales. Additionally, Colorado, Connecticut, Texas, and Virginia also provide their state residents with rights to: (v) correct inaccuracies in their personal information, taking into account the information’s nature and processing purpose; and (vi) opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects. Nevada Residents. Nevada provides its residents with a limited right to opt-out of certain personal information sales. 14. YOUR EUROPEAN AND UK PRIVACY RIGHTS

If you are a resident of the European Union or the UK, you are entitled to certain information and have certain rights under the General Data Protection Regulation (Regulation (EU) 2016/679) (the “GDPR”) or the UK GDPR adopted post Brexit (also referred to herein for convenience as simply the “GDPR”). Those rights include:

  • the right of access to your information.
  • the right to rectify your information if it is incorrect or incomplete.
  • the right to have your information erased (“right to be forgotten”) if certain grounds are met.
  • the right to withdraw your consent to our processing of your information at any time (if our processing is based on consent).
  • the right to object to our processing of your information (if processing is based on legitimate interests).
  • the right to object to our processing of your information for direct marketing purposes.
  • the right to receive your information from us in a structured, commonly used and machine-readable format, and the right to transmit your information to another controller without hindrance from us (data portability).

If you are located in the European Union or the UK and you are or have been a user of our services (including the Service), we may send you marketing communications based on our legitimate interests, subject always to your right to opt out of such communications. Further, if you are located in the European Union, we will never share your information with a third party for such third party’s marketing purposes, unless you have specifically consented to us doing so.

Furthermore, if you believe that our processing of your information is inconsistent with your data protection rights under the GDPR and we have not adequately addressed your concerns, you have the right to lodge a complaint with the data protection supervisory authority of your country.
For purposes of the GDPR, we are a “controller” and you are a “data subject.”

15. UPDATES TO OUR PRIVACY POLICY

StyleScore reserves the right to change this Privacy Policy at any time. If we make a material change to this Privacy Policy, we will communicate these changes to you either via email (if we have your email address) or by posting a notification on the Site. The date this Privacy Policy was last revised is at the top of this page. We encourage you to review this Privacy Policy periodically to check for any updates or changes.
